State Courts and Tribunals
Court of Appeal of Western Australia. This Court determines the appeals for decisions from single Supreme Court justices and other Courts. They have the same jurisdiction as the Supreme Court.
Supreme Court of Western Australia. This is the Highest Court in Western Australia and has jurisdiction except for offences and charges under the Constitutional and Federal Law.
Family Court of Australia and Family Court of Western Australia. The Family Court has jurisdiction over family matters and other charges under the Family Law. It hears matters relating to financial orders, and Children’s custody and maintenance matters.
District Court of Western Australia. This Court has jurisdiction over personal injury claims. Jurisdiction to award up to $750,000 in other matters and to grant incidental equitable relief.
Magistrates Court of Western Australia. Jurisdiction under this Court is to award up to $75,000. Jurisdiction over residential tenancy matters and dividing fences. However, they have no jurisdiction over claims over disputed land.
State Administrative Tribunal. This Court has jurisdiction over reviews of decisions made under Western Australia legislation which may include planning and development, state taxation, guardianship, and disciplinary proceedings.
Federal Courts and Tribunals
High Court of Australia. The High Court has the original jurisdiction over constitutional and is the highest court in Australia.
Federal Court of Australia. Has jurisdiction over federal matters pertaining to corporations, trade practices, and bankruptcy.
Federal Circuit Court of Australia. The Court shares jurisdiction with the affairs of the Family Court and the Federal Court of Australia in most matters. It deals with issues in migration and bankruptcy other than issues under the Family Law as well as other federal legislation.
Administrative Appeals Tribunal (AAT). This tribunal has jurisdiction to review decisions made under federal legislation. Such issues include social security, veteran’s affairs, taxation, and workers’ compensation.
Migration Review Tribunal. The Tribunal has jurisdiction to review decisions made under the Migration Act
Refugee Review Tribunal. This Tribunal reviews decisions related to refugee visas under the Migration Act
Fair Work Commission. They have the jurisdiction to review decisions related to refugee visas under the Migration Act
